Jaya Bachchan wins legal shield for personality rights in Delhi High Court

Jaya Bachchan has moved to bolster her legal safeguards as the Delhi High Court issued an injunction to protect her “personality rights” against unauthorised use of her name, likeness and image.

In the petition, Bachchan argued multiple social-media accounts, websites and e-commerce platforms had been exploiting her persona for profit selling products bearing her photograph, generating AI-driven videos and circulating other materials using her identity without consent. Senior Advocate Sandeep Sethi, representing her alongside a team from Anand & Naik Advocates, presented examples of infringing sites and YouTube channels.

Justice Arora of the Court granted wide-ranging protection, constraining the infringing parties from continuing these activities. The injunction also directed major tech and e-commerce companies including Google, YouTube, Meta, Amazon and eBay to co-operate in identifying the violators and provide Basic Subscriber Information to assist enforcement.

However, the Court made a pointed exception regarding a company selling posters of the 1973 film Abhimaan, in which Bachchan starred alongside Amitabh Bachchan. The judge clarified that this did not qualify as a violation because the copyright in the film resided with the producer, not Bachchan’s personal rights.

Bachchan joins a growing number of celebrities including Amitabh Bachchan, Aishwarya Rai Bachchan, Abhishek Bachchan and many others who have turned to the courts to protect their identity and brand from unauthorised commercial use.
